Abstract

The types of proceedings in cases of administrative violations include administrative proceedings in cases of violations of traffic rules, which were detected by means of video or photography. One of the features of administrative proceedings in cases of violations of traffic rules, revealed by means of video or photography, is the resolution of the case in the absence of a person who is brought to administrative responsibility. Due to this circumstance, the author decided to discuss the issue of ensuring the right to proper management of the person in the above-mentioned form of the administrative process.

The author's research has shown that the right of proper administration in the administrative process in cases of violations of traffic rules that are detected by technical means is not fully realized. The author proposes to carry out legislative changes that will allow the addressee of the administrative act to fully exercise the right of proper administration in proceedings; expand the range of evidence, as a result of which the administrative body will adopt more substantiated administrative acts; in case of possible errors, to avoid senseless appeal in administrative and judicial proceedings, which in turn will allow to bypass the unnecessary waste of resources.
