Abstract

The article focuses on the features of overcoming the gaps (those of enclosing, filling and eliminating) the law along with the concepts  of its logical( induction, deduction and logical conclusion)  and legal devices (analogy of the law and right). The article mainly discusses the conditions of using that very devices and its peculiarities. It thoroughly analyzes the logical and legal theories concerning the origins of analogy and its development.
