THEORETICAL BASIS OF DEFINING THE CONCEPT OF ADMINISTRATIVE ACT IN THE CONTEXT OF DOMESTIC AND INTERNATIONAL LEGAL REGULATIONS

Abstract

The article is devoted to the types and legal issues of defining the concept of an administrative act.  

The purpose of this article is to define the concept of an administrative act on the basis of research into law, as well as to clearly consolidate this concept in the current legislative field of the Republic of Armenia on the basis of international and domestic theoretical and practical experience. 

The article discusses an issue that has been reflected to some extent in works of various authors but has not been the subject of separate comprehensive scientific research and legal analysis of the problems arising around the institute that makes up the content of the topic, which we attempted to do in this work. 

The value and practical significance of this work, as well as its novelty, are manifested in the legal experience of various countries in defining the concept of an administrative act, at the suggestion of the Committee of Ministers of the Council of Europe, as well as in the judgments of the Court of Cassation of the Republic of Armenia, as a result of which the article substantiates the judgment according to which an administrative act is an individual legal act adopted in accordance with a corresponding established procedure, an external manifestation and regulatory influence, which is adopted by administrative bodies or a subject authorized to adopt an administrative act on behalf of an administrative body in order to establish, change or terminate rights, a legal status or obligations for a particular person (or a group of people) in the exercise of their powers, and may also be directed to the occurrence of such legal consequences.
