Abstract

The new Criminal Code of the Republic of Armenia came into force on July 1, 2022. It provides for some new crimes, among which is enforced violent disappearance. The provision for this act has a conventional basis, the forecast of the crime under discussion is among the obligations of the Republic of Armenia, which derives from the International Convention "On the Protection of All Persons from Enforced Disappearance".

The article is devoted to the analysis of the crime of enforced disappearance. The topicality, modernity and scientific novelty of the research are caused by the lack of research into the subject by local scholars. The article reveals the objective and subjective characteristics of forced disappearance, the circumstances that aggravate the responsibility for forced disappearance, and compliance with the convention basis.

The research results, apart from theoretical significance, also have practical value. They can serve as a guide for the bodies that give a legal assessment of the act in question and apply measures of punishment.
