Abstract

The work refers to the elimination and/or overcoming the gaps in the law. It is emphasized that the final elimination of the gaps can only make the lawmaking body by adopting a new law or by supplementing and amending the laws. The gaps overcoming are firstly realizded by the court through the legal analogy or analogy of law. It has been shown that executive and departmental bodies are also involved in the overcoming of gaps within the framework of their jurisdiction. The article also scrupulously sets out the system-forming and “generic” principles that regulate the legislative activity.
