THE METHODS OF DISCLOSING THE GAPS OF LAW

Abstract

The article analyzes the gaps of formal-legal and specific sociological research methods of the law and legislation gaps from the perspective of positive law concept. The study is done by taking into consideration the scientific aspects of legal gaps’ essence along with the classification of “narrow” and “wide” classification. The fact that the above mentioned methods are considered to be the organic elements of the categorical apparatus of general methodology of legal study are also being touched upon. The disclosure of the latter is aimed at filling and/or managing the gaps impeding the defense of rights, herein ensuring legality.
